QUESTION ONE:
Nformi is a Contractor based in Bambili. He bought 100 bags of cement from Beyala on the
01/02/2011 at Fascom Documentation Bambili. It has been discovered that the cement was actually
stolen by Beyala from Kuma Enterprise at Bambui Market on the night of 31/01/11. Kuma
Enterprise now seeks to recover the cement from Nformi. Langai has advised Nformi that, as a
general rule, Nformi cannot have a good title over the 100 bags of cement, even if Nformi acted in
good faith without knowledge that Beyala stole the cement; “Nemo dat quod non habet”. Discuss
Langai's opinion under the sale of goods contract. 15 marks

In a chat between Ngambi and Pandong, Pandong is of the opinion that an agent is at liberty to act
on his own volition and owes no duty to the principal in an agency relationship. Do you agree and
