Instructions:Answer three questions. Question one is compulsory.
Question One (30 marks)
During a Board meeting at ALGO Pic. on June 3, 2019, a. memo was circulated about
a manager, which claimed, among other things, that he 'lived exclusively to satisfy
his own lusts andpassiond. The personal secretary to the Board Chairperson wanted
to send a copy of the memo to the wife of the manager, and was stopped by the
Chairman. The deputy manager, who is envious of the position of the manager; who
was part of the Board meeting at ALGO Pic. and who doubles as a friend to the wife
of the manager, sent a WhatsApp message to the wife about the defamatory
statement in the memo, on June 4, 219, who started divorce proceedings.
Discuss the legal issues involved.
Question nvo (20 marks)
'Private nuisance is a wrong against land, and not the proper cause of action for a
plaintiff who has suffered some form of persona! discomfort or injury only'. With the
help of decided cases, explain the veracity of this statement.
Question three
a. Distinguish trespass to land from nuisance. (5 marks)
b. With the help of decided cases, outline the constituent elements of wrongful
entry on land. (15 marks)
Question four (20 marks)
a. Explain what is meant by strict liability. (5 marks)
b. Outline the rule in Rylands v. Fletcher. What are the limits to this rule? (15
marks)
Question five
a. Define: Trespass to Goods and wrongful interference with goods, giving
examples of both. (8 marks)
b. Outline the remedies available in cases of wrongful interference with goods.
(12 marks)
